hi

need some advice on ESA hearings. I have my first on the 16.8.09 and i am finding it more difficult to get through all the descriptors with the client. It is obviously taking longer than it used to.

Anyhow if anyone has been on to do one....do we just have to look at the limited capability for work aseessment descriptors only? Because i ahe a submision that states "if the tribunal decide that the client does have limited capability to work i respectfully submit that a determination will need to be made on whether she also has limited capability for work-related activity".

So do i then have to also prepare for the work related activity descriptors? because it sounds hard work to me...its difficult just gettingused to the mental health decsriptors but they are different for each part of teh Work capability assessment.

Any advice guys?

As far as I know, you only have to go through the lLCfWRA if the client is trying to be put in the support group. I've done a couple of ESA tribunals where we were just showing that the client had LCTW and not LCfWRA and it was basically pretty much the same as an IB appeal - just asked then to look at the relevant descriptors.
