Child Benefit and 'Interruptions in Education'

Hi,

I urgently need a copy of Commissioner's Decision R(F) 3/60. We're getting a number of cases where parents of learning disabled children have challenged the offer of an unsuitable school place post 16. When they inform Child Benefit that their son/daughter is 'temporarily' out of education pending appeal their benefit is being withdrawn. Reg 6 of the the CB Regs covers these sort of 'interruptions' and allows benefit to be paid up to 6 months where it is "reasonable" to do so. The annotations to my out of date sweet and Maxwell quotes the above decision which seems directly relevant.

Don't have the decision but CCS/2621/2003

may be useful. It refers to R(F) 3/60 & says
"Although I do not rely on this authority for my own decision, it is certainly consistent with the outcome I have reached in this case."
