Someone on DLA claiming carers allowance
Wed 02-May-07 09:55 AM

I am working with a lone parent who is receiving high rate care DLA. She has a young son who also receives high rate care DLA. I assume she could claim carers allowance for him and get the carers premium added to her IS?
However, would this spark a review of her own DLA award and possibly put it in jeopardy?
Thanks.

You can never guarantee that DLA won't be reviewed but I have never come across a CA claim triggering a DLA review. Someone else may know different but there doesn't seem to be any cross-checking system in place at the DCS between CA and DLA claims, other than checking that the person receiving care receives appropriate rates of DLA.

In any event a CA award wouldn't give grounds to supersede as there has been no relevant change of circumstances, assuming DLA knew about her having a child. Indeed it might well be that her child care responsibilities were a factor in her obtaining DLA - attention or supervision required to care for a child can be reasonably required and therefore relevant to DLA.

I would make the claim.

Yes wwr but if her child care responsiblities were a factor in her being awarded DLA I undersgtand she wouldn't have got this if the child had been in receipt of the care comp of DLA

I suppose technically it could but I've never come across it when client's have made similar claims even those couples each with MRC and each claiming CA for looking after each other.

Thanks, that's great. I just wanted to make sure before I did it as I didn't want to upset the applecart with her DLA.
Cheers.

Hi, I have had a few scenario's like this one, for example Mum, Dad, Son on Mid/High rate care. put in a claim for carers allowance for mum to care for son, son to care for Dad and Dad to care for mum, all got the carer premium added into their awards and they are now quids in, this did not spark a review for DLA for either of them. good luck with your claims....in this case Son was over 18 and living with parents.
