Did I dream it?
Thu 04-Jun-09 03:24 PM

I am sure I have seen a decision recently where the Sec State conceded that signing on was sufficient to satisfy the antonissen test for r2r, and further more that the decision in which that concessionw as made was going to be reported but I can't find it anywhere.

Anyone any ideas or have I finally started dreaming decisions up? :-o

Hi Dan,

It wasn't a dream. CIS/0681/2008 (see para 28) and CIS/1951/2008 come out suggesting that 'genuine chance' may be a more stringent test than signing on for JSA, but CIS/4304/2007 comes to the rescue by suggesting that entitlement to JSA is evidence of a genuine chance - see para 31.

ta for that, I was thinking there's a Rowland one out there as well...

Inconveniently 0681/2008 doesn't seem to be on the UT website.

Dan,

Sorry, I made a mistake. The case I referred to earlier is CIS/0601/2008, and not CIS/0681/2008. Very sorry.
