Cock Up in Upper Tribunal Submission
Tue 27-Oct-09 02:54 PM

Could anyone offer some advice?

I've cocked up with a UT1 submission to the Upper Tribunal. Incorrect medical evidence used on one of the points of law (evidence from another case filed in the wrong case). Not guilty of the misfiling, but should have spotted it when preparing the UT1.

UT Judges decision has rejected the submission on both points of law I raised, including the erroneous one.

Can I get the decision set aside or reopened, to allow a new UT1 to be sent with the right details; something along the lines of my stupidity in missing the error, etc.

There is a power for an upper tribunal to review a decision of an upper tribunal under section 10 of The Tribunals, Courts and Enforcement Act 2007.
