Hi I'm just starting to look into this situation but thought I would see if anyone out there has already done so.

Client lives in UK works abroad (6 weeks away 6 weeks here type of thing). Partner & children live in UK.

Pays tax abroad rather than in the UK.

Time in UK enough to be considered ordinarily resident here by IR. So should be joint claim, but do the earnings that are taxed abroad count for Tax Credits??

see regulation 3(4) & (5) of the Tax Credit (Definition and Calculation of Income) Regulations 2002.

The answer to your question would appear to be yes.
