Just a quick question...

Can a carer contine to claim CA when the disabled person's DLA is suspnded during a fraud investigation but no decision has yet been made on their entitlement?

I would say so as technically they are still entitled until a decision is made.

S.70(2) SSCBA - fundamental condition for CA - DLA at appropriate rates must be PAYABLE. While DLA is suspended it is not payable. Entitlement doesn't come into it. So, no, I think CA must stop.
