I may very well be way off here but some HB Regs refer to renewal claims:

1. When claimant dies, partner has 4 weeks in which to reclaim

2. When claimant’s partner leaves property, remaining partner has 4 weeks in which to reclaim

3.End of IS/IBJSA, claimants given 4 weeks in which to make reclaim (although this may still be OK for people starting work or moving onto Pension Credit under different rules)

What will happen in these cases come April??? Will HB only be payable from Monday after claim even if this is within 4 weeks??

To the best of my understanding, the following applies:

1 & 2: 4-week linking rules no longer apply from April - it is not clear if this is an oversight in the new legislation, but in any case there is no replacement linking rule (at least not that I can find, nor many other "on-the-ball" contributors).

3: Unless I've missed something here too, end of IS/JSA(IB) will simply be a change of circs.


For what it's worth, the post-April regs are causing all kinds of confusion to a number of people. They have been badly thought out and not very well drafted - at least in my opinion. I fully expect several scenarios to make it to Commissioners in due course - both by LA's and by clmts.

Re: end of IS/IB JSA - I understand that if someone starts work then this is a change in circs but is this true for someone whose IS ends for another reason eg because of the transfer onto CTC?

Still a change of circumstances as regards new regime, however how this will work in practice, will no doubt vary depending on La concerned.
