My client is a British Citizen. He gets Incapacity Benefit. He has applied for his wife and children to join him and we are expecting that she will be given a no recourse to public funds stipulation. From what I can see there appears to be no problem at all with him claiming an adult dependant addition for her on his Incapacity. Is this correct or have I missed something?

Public funds do not include benefits that are based on National Insurance contributions.

Therefore I do not see an issue here.
