Client was getting HRMC & LRCC. tribunal awarded MRCC but reduced mobility to LRMC, both to take effect from the date of the decision under appeal. Client had made full disclosure of her health etc - department made the decision.
DWP now say they will offset the high to low mob against the low to middle DLA. Means client will not get any arrears.
I think the HRMC was an official error and it seems unfair to recover it. But then, the decision notices say "any DLA already paid to the appellent shall be treated as paid on account of any DLA now awarded."
Any ideas?
