Client is a 24yr old full time student in non-advanced education. He was in receipt of Incapacity Benefit, HB/CTB. 2 weeks ago he was found fit for work as he failed a medical. He wants to claim the reduced rate Income Support until his appeal is heard however I just wanted to check that he would qualify. In order to claim IS as a full-time student you need to have been incapable of work for the past 28 weeks, however as he was found fit for work will he still satisfy this criteria? or can he still be considered unfit for work until his appeal is heard?
