Failure to turn up for PCA

A client, long history of mental health issues, drug abuse, alcohol problems, self harm. All stems from sexual abuse as a child from 2 to 14 years. Has tried to blot out memory, finds prospect of attending a PCA too daunting to discuss reasons for incapcity with officials, albeit a doctor. Has not attended PCA, result:- IS/IB benefit stopped.

Is there any avenue, or recourse to law that she can take?

Had a few of these, client can show good grounds for not attending, proof of conditions etc to be given, new appt could be made if DWP agree.

Appeal could be successful I think.

Any counselling for the sex abuse could be shown as proof of sensitive nature and why PCA missed.

Problem is that this lady does not wish to attend any PCA's as this epispde of her life continues to cause a great deal of anguish. To discuss it openly (she feels) is increasing her problems.

Then you need evidence to show exemption from PCA under the mental health rules and be ready to try and get the pre-altered rules to apply if necessary under CIB 884 2003.
