Several Issues + Students

This encompasses several benefit issues - IS/JSA/HB/CTB, didnt know where else to put it... so hope here is ok..



Client - mature student, lives alone in rented property, on full time University course..

2004/2005 - 1st year of course - received loan
2005/2006 - 2nd year of course - received loan

Didnt do her 3rd year in 2006/2007, instead came out of Uni. She tried to sign on but says this was not allowed, as she was "taking a year out and would be returning to Uni in Sept 2007"... Not had confirmation of this from JC+

Also did not get HB/CTB for 2006/2007 as she says they said "not entitled as they could not assess claim on nil income".. not had confirmation of this from the LA..

2007/2008 - 3rd year of course - says couldnt receive a loan but got £650 from the Uni Hardship Fund..

So questions..

1. Would she have been eligible for JSA in the 2006/2007 period when she was not in Uni..?

2. She sat her last final exam last week and attended JC+ yesterday to see if she could sign on. They said she couldnt until official leaving date of 1 June. Is this right as I read in CPAG that the holiday after you finish is included..?

3. When would she be eligible for HB.. Would she be entitled in the year off year, would she be entitled now, on on official leaving date.. Would she be entitled for this year due to only being able to receive a Hardship grant and not being entitled to the student loan for 2007/2008 (cant understand why she was not eligible for the student loan this year..?)

4. I feel that if what she says is right about being told she could not get HB/CTB on her year off due to nil income, that this decision is up for argument. Obviously I would need to know that the LA have actually refused a claim based on this..
