DLA Appeal back pain and depression Mon 26-Mar-07 12:20 PM
Client has quite severe back pain and is awaiting sacroiliac injection after she found no relief from a facet joint injection. She is also suffering from moderate depression with some days lot worse than others. Her 5 yo son has 'slight' Aspergers syndrome
DLA refused. DM says can walk outside without any balance probs (no mention of pain), that there's no indication of congnitive difficulties so doesn't need guidance and supervision, is reassured by having someone check on her but doesn't need continual supervision to avoid danger and that probs looking after son can't be taken into account.
I'm more or less ok with challenging the above but was looking for some CD's - there are so many for mobility I'm having difficulties and am struggling with ones for depression and more so for ones about looking after son as I realise it has to be pretty much hands on help.

CDLA/4352/1999 might be of use to you. This decision looks at the case of a disabled mother and whether or not looking after a young child qualifies as 'attention' in connection with the claimant's bodily function of movement.
