Means-tested benefits and overpaid WTC

I think this will already have been covered previously. If WTC payments which continue in error are taken into account as income on an IS/ibJSA/irESA award and are subsequently deemed to be overpaid and recoverable, can the IS etc award be revised to remove the WTC as income once the WTC overpayment has been repaid?

Hi if an overpayment has been caused by official error / the revenue calls this failing to meet its "responsibilities"/, or where recovery would cause hardship the revenue may decide not to recover all or part of an overpayment. See p.1341 from CPAG Welfare... book.
It may help to see whether the overpayment should be recovered.
