Pension credit -SDAA and 'Granny flat'
Fri 30-Nov-07 02:57 PM

I have a situation of someone who has moved from her home into a 'granny flat' in her sons house. However she only has a bedroom, bathroom and little lounge and shares the kitchen facilities with her son. She lost her SDAA at appeal as she is deemed to live in her sons home due to shared facilities. She has parkinsons however and cannot even make a hot drink and only uses a microwave. I am trying to pursuade her to sort out a kitchette in her flat but has little room. Wondered if anyone had come across this situation before and whether I could argue that she cannot use the kitchen facilities so is not sharing the kitchen. Also had an Assessed Income Period until 2009 but gather this is a change in circumstances rather than income and therefore Assessed Income Period ends. Is this correct? Thanks
