One of our solicitors has a benefit query and I can't resolve it so hope you can help. His client (X) had a large compo payment (Court of Protection). He is the Receiver and deals with all X's finances and a condition of this is that X's benefits including IS are paid to him each week and he subsequently makes a weekly payment to X. X has recently disclosed he has started cohabiting with someone also on IS. He has been strongly advised to disclose this. Have already advised the solicitor that as offical appointee he will be liable for any overpayment etc.
Problem is once they are paid as a couple the solicitor will be unable to accept the couple rate of IS as it is X who is the client. I don't know of any way the solicitor can be paid a portion of the couple's IS and therefore don't know how to get around this. Does anyone know of any similar instances or can give a clue as to how to deal with this ?
