I've got an SDA appeal where the claimant needs to demonstrate they're 80% disabled to get SDA reinstated. There are mental health issues plus CFS/ME. We've got GP report, psychologist report and a fairly useful medical report from a recent PCA assessment.

Bonner (p.294)quotes R(I) 30/61 "a man entitled to an assessment of 100 per cent is not necessarily totally disabled, and that any scale of values which a member of an assessing body has in the back of his mind should take account of that fact.” Does anyone have R(I)/61? And does anyone know of any other gems like this? DWP have assessed claimant as 60% disabled following a medical assessment.

Hi Jimt,

I can send you a (very) old submission for an SDA appeal that you might find useful.

I didn't use any commissioner's decisions but treated the appeal like IDB and set out all the specific losses of faculty and resultant disabilities.

Comparisons with the fixed scores are helpful and I used that to good effect.
