Temporarily incapitated work seeker?

Can a 'work seeker' (EEA citizen) retain a right to reside for HRT purposes if they become temporarily incapacitated?
Case is of Portugese citizen, previously a worker, then claiming JSA as a work seeker becomes sick. Is hospitalised under s3 of MHA and likely to be sick for more than two weeks, but a full recovery is likely.
There is some ambiguity in sources of information on this point.

try...Statutory Instrument 2006 No 1003 Immigration EEA regs 2006 ..... "qualified persons" section 6 (2) (a)

... a person shall not cease to be treated as a worker.... temporary unable to work"
