I'm representing at an ICB appeal on 06/03/06. I was wondering if anyone had ever successfully applied the above regulation on the basis of their client having a severe drug addiction and if so how they presented their case?

I have never got that far, usually the effects of substance misuse fall to qualify the person under the mental health assessment so the Chair's halted proceedings. I find that if you do a double scenario for the mha, one under the influence and one without usually convinces the Tribunal. Good Luck!
