is there any link between IB and DLA i know of a person waiting for DLA appeal,in the meantime had to fill in there IB50 sent it back had not heard from dwp for a while phoned up and they said there was a 6week waiting for a medical,they receaved a letter from dwp today saying that they had met the threshhold of incapacityunder the pca,they did not have to have a medical,i find this unusual,or is this normal..

You can pass the PCA on the IB50. You can't fail it without a medical.

Why not use the evidence from the PCA to support the DLA appeal if appropriate . If client stated could walk less than 50m , although the test is different it would still be persuasive evidence i.e. the DWP/SoS have accepted he has reduced walking ability.

You could point out that the information put in the questionnaire, which is not related to work, but to an ability to perform certain functions and actions, has been accepted by the DWP. and that the department should use this information in looking at any claim for benefit as indicated on the Incapacity Questionnaire.

Declatarion

"I understand that the department may use the information which it has now or may get in the future to decide whether I am entitled to:
-the benefit I am claiming
-any other benefit I have claimed
-any benefit I may claim in the future."

There have been a lot of cases where the Incapacity information has sparked a review of DLA.

Though interestingly I have never seen them use the evidence to support a claim itis always to reduce or stop DLA. See my link in the disability topic forum
