Transitional Housing Benefit Regs

Hi all
Could anybody point me in the right direction of the old Transitioanl Housing Benefit regs.

I specifically want to check the date HB was supposed to be paid too, was it 31.3.03 or the Sunday following 6.4.03?

and regs regarding the treatment of support related service charges and comparable services if classed as excessive.

Any help would be extremley appricated.

Paul, Monthly/daily paid rents were entitled to THB until 31st March weekly paid rents up to 6th March.

Schedule 1 of the Hb regs covers comparable services.

Excessive service costs
3. Subject to paragraph 1A, where the relevant authority considers that the amount of a service charge to which regulation 10(1)(e) (rent) applies is excessive in relation to the service provided for the claimant or his family, having regard to the cost of comparable services, it shall make a deduction from that charge of the excess and the amount so deducted shall be ineligible to be met by housing benefit.

Do you know where i might find the regs relating to the payment of weekly THB up to the 6.4.03. I have an appeal soon where HB have stated in the submission that the appealable period is up to the 31.3.03 not the 6.4.03 and would like to be able to quote them.

Was there a seperate set of reg albeit temporary covering THBS?

The THB Regs, otherwise known as Schedule 1B of the HB Gen' Regs were repealed, effective from the above dates, by Reg 13 of the HB (General) Amendment Regs 1999, as amended by Reg 5 of the HB (General) Amendment Regs 2003.

I think you are after the

The Housing Benefit (General) Amendment Regulations 1999
Statutory Instrument 1999 No. 2734

Regulation 13

13. Cessation in operation of these Regulations
These Regulations shall cease to have effect -

(a) in any case where rent is payable at intervals of a whole number of weeks, on 6th April 2003; and

(b) in any other case, on 31st March 2003,

and the Housing Benefit Regulations, the Housing Benefit (General) Amendment Regulations 1995 and the Housing Benefit and Council Tax Benefit (General) Amendment Regulations 1997 shall apply thereafter as if the amendments made to them by these Regulations had not been made.

Wish me luck in the appeal, got to convince chairman charges are reasonable not excessive
