More Housing Costs Headache

Clients wife dies early 2008. Continues working then claims Widowed Parents Allowance in Jan 09.

JCP decided 39 week QP for housing costs. Apart from the argument about the 13 weeks I'm looking at whether he is exempt from the 39 wk and should be paid after 8/26 weeks due to death of wife.

IS Regs sch 3 para 8 provides for exemption from 39 wks for those who claim IS on death of partner. Would it mean he had to claim IS (or claim WPA and be in the QP for ISMI) as soon as she died or have I got it completely wrong?
