Trying to find R(U)13/52
Thu 01-Apr-10 02:16 PM

Does anyone have a copy of this case? If I read a reference to it once more in a DWP sub I will chew the carpet. There must be something in it I can use but can't get hold of a copy.

I don't have a copy in any form. However, if the DWP is relying on a legal authority, I'd be asking the Tribunal to direct the DWP to provide a full unedited copy of it. In the event of the DWP not being able to produce, I'd ask the Tribunal to ignore any legal argument based on it.

Don't have a copy, but there is a very brief summary in Volume 1 of Neligans Digest (para 1.5.9.i):

Just cause not accepted in cases relating to work and business matters:

The claimant left his employment voluntarily because he considered it to be beyond his ability although his employer was not dissatisfied with his work. He also produced some evidence of physical disability, but it was held that he did not have just cause for voluntarily leaving his employment. See, in particular, paragraph 9 as to considerations for relating to physical disabilities to be taken into account.
