Pension Credit and loss of Occ pens due to Debt Relief order
Mon 08-Mar-10 01:46 PM

Hi

does anyone know if a client loses their occ pen due to a debt relief order, will pension credit reassess taking into account the reduced income or will they view it as a intentional deprivation of income?

Thanks Helen

Can you be more specific please? People in DROs do not pay anything towards their debts so they cannot lose their pension (assuming it is a pension in payment) as a result.

If the occ. pension has not yet been taken (which - from what you say - does not appear to be the case) then it is an asset &, if it is valued at more than £300 - which is almost certain - the person is barred from going into a DRO.
