Maternity and other benefits
Mon 18-May-09 09:50 AM

Lithuania national, working 16hrs per week, pregnant (25 weeks), 3 children, no partner.

I only spoke with her over the telephone so I still do not know the full circumstances until she comes to see me next week.

Would she be entitled to SSMG?
What else should I look at in terms of maximising her income?

Thanks

P.S. she worked here for more than 3 years and she finished the 12 months period or WRS

She can claim the SSMG is she has been awarded a qualifying benefit, has received health and welfare advice about having a child and claims within the time limits.

The qualifying benefits are; IS, PC, JSA(B), CTC (at a rate which exceeds the family element]) or WTC which includes a disability or severe disability element.

She can claim within 11 weeks of the expected due date or 3 months following the date of the birth.

If she is awaiting a decision for a qualifying benefit and her SSMG is refused because she does not have a qualifying benefit then she can re-claim within 3 months 3 months of being awarded the qualifying benefit.

There is also the health in pregnancy grant, ChB and extra CTC.

Regarding R2R she should not lose this because of pregnancy or disability. Though she will not have permanent R2R until she has been legally here for 5 years.

Regards
