Income Support- Estrangement
Fri 30-Apr-10 10:19 AM

Hi All
You can qualify for IS while in relevant education on various grounds. One of these is: "you have to live away from your parents and any person acting in their place because.....there is a serious risk to your physical or mental health"
Can anyone point me to caselaw examples where this has been sucessfully argued?
Thanks

There is a good deal of caselaw on the subject.

I suggest you start with CPAG's Social Security Legislation (vol ii) and the annotation to regulation 13 IS regs.

If you don't have this book, then post up more specific details about your case so we can point you to appropriate authorities.

Alternatively, using the 'advanced search' feature, a search in the forums for 'estranged' and 'estrangement' revealed up a few threads that might be relevant in the income support forum.
