DLA appeal previous evidence - no CoC

Dear all,

I'm looking for a CD for an appeal tomorrow.

A commissioner has decided - I believe in connection with the PCA (I have a DLA case) - that were the claimant asserts there has been no CoC, the previous evidence should be included in the appeal bundle.

Anyone know the reference...?

Tony,
Try CIB/3985/2001. Also commentary in Sweet and Maxwell, Rowland and White Vol iii page 545 (2009/10) which proves helpful.

Thanks very much Quinn, just the ticket - and the CD you suggests give us extra ammo as we have a dispute with TTS regarding a postponement and this CD covers the issue well.
