What's the current situation with benefits when joint residency? Unsure mum's employment status but dad was refused benefit some time ago as it was decided mum was primary carer - she has child 4 nights and client 3 (unless we get 8 day weeks this is always goung to be the case). I thought I'd try Hockenjos just to get ball rolling but DWP reply that as the judgement was in respect of JSA only it's not relevant to IS and in any case my client is way out of time. I would have thought discrimination is discrimination whatever the benefit - am I wrong and if so why? Anyone any wiser at the moment?
