Carers Allowance & Child benefit

I know its Friday but ..... Can a child claim Carers Allowance while their parent receives Child Benefit and Child Tax Credit? There are no means tested benefits involved, my head tells me no, the full time education rule, and childs income, working 24 hours, is caring remunerative work? I can't find anything specific in the regs.

Child Benefit. Full time education is 12 hours or more. A 17 year old child finished college course and is in the child benefit extention period under the terminal date rule therefore CB & CTC is payable until Aug 31.

Carers Allowance. Can't claim if on full time course which is 21 hours or more. The child is not in a holiday break they have actually ended their course. However they are probably going to enrole for another course starting in Sep 07 but want to claim CA in between courses.

All of the regs specifically mention CB & Incap, JSA, IS but no mention of CA.

Also, if it is not remunerative work and the course is more than 12 but less than 21 hours can both be paid (providing still giving 35 hours care)

If you can give me the reg that prevents this I would be v grateful thank you in anticipation.

Hi Jeanette!

I think the answer is they can claim CA at the same time as CTC/CB. I have a client doing this and had to think twice about it like you but it went through ok.
