DLA Appeal: CFS/ME case
Fri 23-Jan-04 12:21 PM

I have an appeal next week for a young woman w/ severe CFS symptoms who lost lowest rate Care & higher rate Mob on review. EMP report is contradictory & reveals that he does not really know about CFS: "typical history...typical of the condition". Have sent submission referring to decisions that I don't have copy of (CDLA/2822/99 and CSDLA/894/01. Would particularly appreciate a copy of the former. Also, I'd like any more recent relevant decisions, not just about physical cause. Am also going for middle care rate cos appellant has had to move back into family home where her mother gives f/t care - arguing continual supervision w/ fallback to attention. Am concerned Trib. may only award lower care on basis of the cooking test. Am now attempting to link this w/ similar request made by Shazza on old discussion forum so here goes http://www.rightsnet.org.uk/forum/disability/1271.html

CSDLA/894/01 can be found at -

Hope that helps
