delay in getting an appeal heard

Hi there,

Has anyone had success at getting the Tribunals Service to direct that an appeal be heard?

I have a case that is 6 months old now - appeals against termination of ICB for a couple both alleged to be working. I have threatened the DWP appeals service with maladministration etc but I thought that the Tribunals Service could direct a hearing in circumstances such as these i.e excessive delay?

I did send off the stuff to them with a detailed covering letter explaining what I was asking for but they have just sent it back saying it is not on their system as the DWP have not done their submissions!

Hi. I have had a couple of cases where the appeal submission was not forthcoming and so I wrote to the District Chair of the Appeals Service asking for a listing. On both occasions this was successful. I would suggest that you explain the steps you have taken to progress the matter with dates in the request letter.

R(H) 01/07 (aka CH/2812/2005) may help. In short, there *may* be circumstances where an LA can be bypassed. Don't see why the same principle can't apply to the DWP.
