Income support as a carer when DLA not in payment

Hi

Wonder if anyone can help me with a quick query? Have a client whose child was in receipt of middle rate care DLA and Client was getting CA and IS. On review DLA dropped to low rate care and has just been returned to middle rate on appeal.
In the mean time cl ws advised to claim JSA by JCP as no other way of claiming IS.
I just wanted to check whether the rule regarding paying IS as a carer for up to 26 weeks or the determination of claim covers appeals of existing claims as well as initial claims.
Their case is further complicated due to right to reside issues as they were getting IS prior to May 2004 have just had JSA for 6 months and this has ceased and new claim for IS refused on grounds of Right to reside (the family are Dutch). Would official error work in this case if it could be shown that they could have remained on IS whilst appeal was being decided?

(sorry realised it may not be quite as quick as thought!)
