Room needed for carer

I have a client living in a two bedroomed house and has only been awarded LHA for one bedroom. She needs two bedrooms as she has 24 hour care. I have applied for DHP but this has been turned down because rent liability will not be for short period.
She did not appeal against original decision on HB award and I would like to try and go through a challenge against original HB decision made in September 09.
I have found decision regarding two seperate properties classed as one for carer. Birmingham City Council v IB. I was wondering if I could use this decision to argue 2 bedroom property is needed for carer and/or if there is any other decisions that could be of use.
