Under the IS regs - Reg 40(5) - the asylum support for essential living needs of the partner and any dependants is disregarded as income however there is no equivalent reg for ib-JSA - it would be expected after Reg 103(6).
I'm confused as to what happens in practice cos the ib-JSA is taken into account as income for purposes of asylum support (for guidance on how they calculate it see NASS Policy Bulletin 11) so does the DWP take into account the reduced (to take account of the ib-JSA) payments of asylum support and NASS take account of reduced (to take account of the asylum support) ib-JSA vice versa?! I can't see the calculation being correct very often.
Does anyone know anymore or if anything is happening about this?
