I have just seen someone who would like my assistance appealing a PC decision that her Portuguese mother has no RTR.
Daughter (also Portuguese) came to live in UK over 5 years ago and claimed IS in 2006. Paid ever since.
Mother then came to live with her 12/04/06 because daughters husband had died. She subsequently became ill and now gets HRAA.
Daughter has apparenlty applied for permanent residence based on being here for 5 years but has not heard from her Solicitor in some time.
Is there any argument for mother? Was looking at family member of EEA national who has permanent right to reside. But then she wasnt dependant in the country of origin so now I'm a but stuck.
