i have a client who made a claim for WTC and was at the time claiming DLA. sometime later her DLA claim ended and she didnt notify tax credits which has led to an overpayment, understandably.

my question is, do tax credits have to offset any O/P by any entitlement the claimant would have had had they have notified of the change, in the same way that housing benefit do

should they just be recovering the extra amount paid through the disability element or the whole amount paid after the DLA ended?

fortunately, i rarely get in tax credit problems
