Morning all,

I know there are commissioners decisions out there which explored the definition of exempt accommodation and also looked at the level of support and/or care that a resident required. I have a feeling that commissioner Turnbull and Jacobs have both made rulings on this subject.

Is anyone able to point me in the direction of these decisions and provide me with numbers of any of the relevant decisions please?

Any help would be much appreciated.

Relevant CDs/UTDs looking at the level of support include:

R(H) 7/07
CH/1289/2007
CH/200/2009
R(H) 4/09**
CH/1246/2007 (interim - subsequently formed part of R(H) 4/09)

** The FULL version is the pre-reported release. The reported version is edited (somewhat unhelpfully in my view).

Others where the amount of support was considered along with other matters include:

CH/760/2008
CH/4432/2006
CH/150/2007

Bear in mind that care, support or supervision must be provided by, or on behalf of, the landlord. If this part of arrangement is not (genuinely) satisfied, the claimant cannot fall within the exempt accommodation definition.

Kevin, I can't find CH/760/2008 on rightnet briefcase. Any suggestions as to where I can get a copy of this?
