IS migration to CTC

I have a client who is in receipt of Income support with the child premiums i.e. her claim has not been migrated to Child Tax Credit as yet. Client has had a lone parent interview and she has been told to claim Child Tax Credit client doesn’t want to due to problems her sister and others have had with Child Tax Credit.

Can they make her claim Child Tax Credit? I thought that the process had been delayed due to problems?

Can my client refuse to claim or does she have to do as she is told?

P.S. My client has to attend a meeting with the adviser today at 1 so any replies before then would be appreciated, I do not seem to be able to find an answer either way as to her rights.

See Advisernet 9.4.4.15 para 120.

No, your client doesn't have to claim CTC.

No, I managed to speak to the lone parent adviser who said it was, as usual, the 'law'. I asked her which law and then she agreed as if just by magic that it didn't apply to my client.
