AIP's Wed 17-Mar-04 03:45 PM
client 89 yo with AIP 5 yrs. He's considering selling up and moving into sheltered accom (as opposed to nursing/care home). My understanding is that if he sells his house within the AIP, the capital isn't taken into consideration and he'll also be able to claim HB/CTB ?? Additionally I consider he should have been entitled to 7 yrs AIP as Reg 37 SPC(CTMP) Regs so I assume we appeal now ?
Like others I'm still bemused by this disregarded capital - causing me to frown, do 'strokey bearding' and slow headshaking....it's 'agin nature'.

I was under the impression that a change of address is a major life change and therefore prompts a review, a revised decision and a new AIP. Am I wrong? Be nice if I am..........

Well, I'd done a similar for another client and then the DWP told me me it'd not be considered a life change if they move into RSH supported housing - not for me to query the reasons why particularly as it all went smoothly for the other client.

ending AIPs Fri 20-Aug-04 04:36 PM
The specific circumstances that bring an AIP to an end are set out in legislation (mostly in SPC Reg 12) I do find it strange that whereas moving into residential care is a change of circs that brings an AIP to an end, other similar changes (such as those above) don't end the AIP
