second property
Wed 25-Nov-09 03:21 PM

Afternoon folks

Client, 62 claimed JSA (C) from May - November 20th. Is now trying to apply for PC's. Situation is that both he and his wife live in seperate properties (for approx 2 years). Both properties are jointly owned by husband & wife, with no outstanding mortgages.

Am i right in thinking that the pension service will treat the property that his wife lives in as capital as his wife is only 59 and the disregards do not apply.

If that is the case would the client & wife be able to sign over his/her share in each property so that they each own 1 property outright? Would there be any notional capital issues if this route were to be pursued?

Many thanks
Dominic
