A 22 year has had his Incapacity in youth claim refused as he has been deemed as a full time student. He has completed 1 year of 3 year degree course and become ill. The University has allowed him a 1 year deferal in order that he can pick up his course again if he is fit go back. He has been sick for 196 days, has not had a loan for this term and is having his tuition fees returned for this term.

Has anyone had any similar cases and can advise on best course of action. I'm putting in an appeal for now sighting SI 1194/2946,reg17 and following general note (see p.671/2 of non means, sweet and maxwell)

Any suggestions would be greatfully received.
