mortgage protection insurance
Tue 12-May-09 10:53 AM

I'm sure I've seen somewhere that mortgage protection insurance payments are not taken into account as income for people in receipt of Pension Credit in the way they are for those under 60 in receipt of means-tested benefits. However, as is the way with these things, I now can't find what I'm sure I saw - or anything concrete to the contrary.

Can anyone help?

As far as I know mortgage protection policy payments which are used to meet repayments on a mortgage or on a loan for certain repairs and improvements will be disregarded in full.

For IS under IS Regs Schedule 9 paragraph 29

Have you tried looking under the PC regulations Schedule IV? For some reason I can’t open Statutory Instrument 2002 No. 1792.

Regards

Schedule IV of Statutory Instrument 2002 No. 1792 can be found on the following link but I could not find any mention of the disregarding of mortgage protection payments.

51064 of the Decision makers Guide relating to ESA states:
Insurance policy income should be taken fully into account except for income from a mortgage protection policy.

Info found here:

http://www.dwp.gov.uk/publications/dwp/dmg/pdf/ch51.pdf

Also look at sch9 para 29 of the Income Support (General) Regulations found here:
