Pension Credit and arrears
Thu 13-Jul-06 10:31 AM

Hi I was wondering if someone could answer this question. What is the maxium amount the council can take off someone if they are in arrears. I have a client who is behind in payments i think £400+ in arrears and he is on pension credit. What is the resonable amount they can take off his pension credit?

Its £2.90 that can be deducted from pension credit for arrears of council tax and paid direct to the council. But the council needs to get a liability order from a magistrates court and appy to the pension service to make the direct deduction to reduce the arrears. The pension service can also make deduction for the current council tax due to prevent further arrears. So its not the council that makes the decision about how much - its the Pension credit rules.
