overpayment of aa and sp following a death

Hi, attendance allowance and the pension service were informed separately of date of death. a letter has been received re overpayment of both benefits, they were paid 4 days after death, 2 weeks monies. I understand that payments are made in advance. Does this recovery have to be paid back? no regulations quoted?

Where the payments made on the bank run that went out before notification of death received?

aa unit informed day after death I think, sp may have been notified a couple of days later, ie after the run.

Disclosure must be to the office that administers the benefit. For an overpayment to be recoverable the failure to disclose must be the cause of the overpayment. If the administering office had the relevant information at its fingertips but failed to act on it then the overpayment might not be recoverable. Any payments for a period after effective disclosure are unrecoverable. Overpayments paid into a bank account where it has been too late to stop the bank run are recoverable if the claimant was properly notified of this power and agreed to the arrangement.

as far as I am aware payments were into a post office account and no agreed arrangements made. Just received an o/p letter 2 months later.
