Reduced Earnings Allowance

Many moons ago Sylvia at LCC take up pointed out that there was no bar to someone claiming REA after retirement if they hadn't claimed Retirement Allowance.

Does anyone know whether this still applies or have they brought a reg in to stop it?

I am also looking for the answer to this question.

Both the CPAG book and the Disability Rights Handbook say you can still do this but I am struggling to see how this is possible.

Client has been told by Industrial Injuries Unit in Barrow to delay his claim until 3 months after his 65th birthday so he can get and keep his REA. He has not worked for 2 years.

Before I advise him to do this I would like to be convinced myself that is is OK.

I cannot see how this 'loophole' works. Can anyone explain it to me please?

I finally have a successful outcome of my case.

My client, who is in receipt of IIDB, waited until 3 months and 1 week after his 65th birthday. He then claimed REA. The REA has finally been paid and backdated 3 months (to just after his 65th birthday). He has been awarded £57.44 per week.
