Do we have to enclose all medical reports with a DLA form

Hi

There is a question on the DLA application form that asks

"Do you have any reports about your illnesses or disabilities?
These may be from a person who treats you, for example, an occupational therapist, hospital doctor or counsellor. It may be an assessment report, a care plan or something like this."

It also asks for copies if we have them.

Do we have to include copies of stuff that is not supportive and if so would this include EMP/Healthcare professional reports.

You don't have to enclose anything at all or you can enclose whatever you want but if you enclose a report you must enclose the whole of it and not just selective parts.

If the report is part of an appeal submission, would you have to enclose the whole of the submission?

a report shoudl not be part of an appeal submission. your submission should refer to the reports disclosed.

but frankly, if you don't FULLY disclose and they find out later, you've done your client no service.

an unfavourable report, or part of report, should be addressed head on in your submissions and with evidence in support of your submissions on that point.

Sorry, I have not explained myself very well.

I have a client where I do not have the original copy of the report from the consuItant but I have her Incapacity Benefit appeal sumbission which includes this report. Obviously the appeal submission is numbered.

I now want to help the client apply for Disability Living Allowance. Do I have to include the whole Incapacity Benefit submission or just the report from her consultant.

just the report.

Nevip would not ticking no to the question about reports if we have got them be lying and therefore illegal?

And, you could always leave the question unanswered. There is no legal obligation to tick the box one way or the other.

Also, lying, per see, is not illegal or unlawful. But I suppose there could be issues around misrepresentation which could lead to charges under The Administration Act.

What about a GPFR and advice from medical services from a previous (but very recent) claim that went to appeal?
