Housing Benefit extended payment schemes

Hi, am puzzled!

Can anyone point me towards a regulation or circular which says that couples where income support has ceased due to commencing work, but the non-working partner continues to get incapacity benefit, are not entitled to the four week run-on/extended payment of housing benefit?
I've just been through A12/2008 and can't find anything to confirm this, but this is what I'm being told by a benefits office. I know the rules changed with the introduction of ESA but didn't think the circumstances of the non-working partner came into it, provided a qualifying income-related benefit had ceased.

Any help would be gratefully received as I'm going cross-eyed staring at online circulars!! Many thanks

Your post has prompted me to look at the EP regs for the first time. I had no idea there were so many, and that contributory benefits are qualifying benefits!!

From a quick look, I would suggest that your LA might be confusing reg 72 with reg 73.

I think I would appeal simply on the grounds that reg 72 applies.
