Incapacity Benefit and Exemption

Hi, I have a client who claimed IB 8 years ago due to being diagnosed with MS - he attended a PCA and was awarded benefit as his condition was classed under the exempt criteria.

My client had no further contact from IB re his claim and continued to receive payment for the last 8 years without any problems.

In Nov 2005 he received a letter from IB asking for updated details of his GP - he provided these and it appears that IB consequently sent his GP form IB113 (without apparent authority from the client) asking for info. The GP appears to have provided very little info but did state that client has MS - this resulted in the client being asked to complete an IB50 and then attend a PCA. He failed the PCA getting 0 points and states that even though he told the Doctor at the PCA of his MS and previous exemption, it was not noted.

Now, re exempt cases, can IB still review the case and request a PCA? Nothing has changed re his condition, his MS is not cured and he still has the same issues he had 8 years ago?

Any suggestions?

Exemptions can be reviewed. How long before it is reviewed normally depends on the medical advice gathered at the time he was deemed exempt.
