HB while bailed to reside away from home address

Under reg 5<8b>c benefit is allowed for up to 52 weeks temporary absence if the claimant is remanded to a bail hostel - However, our tenant has been released on bail pending trial but only on condition he does not return to his home address and stays with a family member in another town. HB has been refused. This seems odd as he would have been allowed benefit if he was remanded to a bail hostel or decided to not apply for bail and remained in custody What if he was subsequently cleared of the offences? Any ideas?

I would recommend that you read Commissioners decision CH/4574/2003 as that might assist you...
